Customs Clearance

There is a no of laws, rules, and regulations governing export and import of goods.  We undertake customs clearance of import and export.  Clearance of goods for export means doing due diligence in terms of:

  1. Exportability under Policy angle. It means that to check whether at the very outset goods are permitted to be exported out of the country.
  2. Ensuring that all documentary requirements in terms of Letter of credit or as required by the exporter
  3. Ensuring that all requirements for availing duty drawback, chapter 3 incentives, are met while filing the shipping bill for export.
  4. Ensuring that all requirements for export under advance license or EPCG license are met.

 

In the case of clearance for import, we explore all options namely:

  1. Duty-free
  2. Partial exemption from the payment of duty
  3. Full exemption from the payment of duty
  4. If none of the above are available, then, full payment of duty

All the 3 options are explored when perusing the documents before filing for import.  Again, all these are applicable for the import of machinery as well as raw materials and components.

In the case of import clearance of machinery, we have very good experience and developed expertise in terms of safe handling and delivery of the cargo. Both used and new machinery are handled with care.

In the case of used machinery, valuation is always subjective.  Therefore, customs require valuation report from their approved panel of chartered engineers.  We coordinate with chartered engineer and provide necessary details to them and obtain Certificate from them.

Import of machinery under EPCG Scheme

Export Promotion capital goods scheme (EPCG) provides for duty free clearance of new machinery to be engaged in export production.  In terms of existing laws, import of used machinery under EPCG scheme is not allowed.   Adherence to set procedure for duty free clearance is important.  We go through the formalities and help our clients avail the scheme.

Import of machinery for Exhibitions held in India.

Such imports are provided the benefit duty free if conditions as per notification 3/89 are met.  We ensure that such conditions are met and trouble free custom clearance for display of cargo in the exhibition.  Similarly, after the exhibition is over, the imported goods are to be re exported back.  Identification of machinery with respect to import documents is essential.  We are experienced in this activity.

Another option available for display purpose is the ATA caranet route.  We are experienced in this type clearance too.
